These Terms & Conditions govern services provided by Santa’s Superior Lights (“Company,” “we,” “us,” or “our”) through SuperiorChristmas.com and through any estimate, proposal, invoice, work order, service agreement, or other communication with a customer.
By approving an estimate, scheduling service, paying a deposit, or allowing work to begin, the customer agrees to these Terms & Conditions.
Services
Santa’s Superior Lights provides professional holiday and Christmas lighting services, which may include:
- Custom lighting design
- Installation of holiday lighting and decorations
- Maintenance and service during the season
- Removal and takedown
- Storage of lighting and related materials
- Other seasonal decorating services agreed to in writing
The specific work included for each customer will be described in the applicable estimate, proposal, or work order.
Estimates and Pricing
Estimates are based on the design, materials, measurements, access conditions, and scope of work known at the time the estimate is prepared.
Changes requested after approval may result in additional charges.
Any work, materials, decorations, accessories, extension cords, timers, clips, labor, equipment, or services not specifically included in the approved estimate may be billed separately.
Pricing may change from season to season due to labor costs, material costs, property conditions, design changes, or other business expenses.
Deposits and Payment
A deposit may be required before installation is scheduled.
Unless otherwise stated in writing, the remaining balance is due according to the payment terms shown on the estimate or invoice.
Customers are responsible for ensuring payment information is accurate and available when payment is due.
Past-due balances may result in suspension of maintenance service, cancellation of future service, or removal of installed materials.
Scheduling
Installation and removal dates are estimates and may be affected by:
- Weather
- Safety conditions
- Equipment availability
- Material availability
- Property access
- Crew scheduling
- Emergencies or circumstances outside our reasonable control
We will make reasonable efforts to complete work within the scheduled timeframe, but exact installation or removal dates are not guaranteed unless specifically agreed to in writing.
Weather and Unsafe Conditions
Our crews will not perform work when weather or property conditions create an unreasonable safety risk.
This may include high winds, lightning, ice, snow, heavy rain, unsafe roof conditions, or other hazardous circumstances.
Weather-related delays do not constitute a breach of the service agreement.
Customer Responsibilities
The customer is responsible for providing safe and reasonable access to the property.
The customer must notify us of known hazards, including but not limited to:
- Underground utilities
- Irrigation systems
- Invisible fencing
- Septic systems
- Fragile landscaping
- Loose roofing or siding
- Electrical problems
- Structural issues
- Animals on the property
- Restricted access areas
The customer is also responsible for ensuring that exterior electrical outlets and electrical systems used for holiday lighting are operational, properly grounded, and suitable for the intended load.
Electrical Service
Holiday lighting requires functioning electrical power.
We are not responsible for problems caused by inadequate electrical capacity, defective outlets, tripped breakers, faulty GFCI outlets, existing wiring problems, power outages, utility interruptions, or other electrical conditions outside our control.
If electrical issues prevent lights from functioning properly, additional service charges may apply when the issue is unrelated to our installation.
Lighting and Equipment Ownership
Unless otherwise stated in writing, lighting, wiring, clips, timers, extension cords, decorations, and other equipment supplied by Santa’s Superior Lights may remain the property of Santa’s Superior Lights.
Payment for installation services does not automatically transfer ownership of Company-owned lighting or equipment to the customer.
Customers may not remove, modify, relocate, cut, splice, repair, or alter Company-owned equipment without authorization.
Design Appearance
Lighting layouts are customized to the individual property.
Actual appearance may vary slightly from photographs, renderings, drawings, previews, or prior-year installations because of property conditions, mounting locations, product availability, landscaping, rooflines, weather, or installation requirements.
Exact bulb placement cannot always be guaranteed.
Maintenance During the Season
When seasonal maintenance is included in the customer’s agreement, we will make reasonable efforts to repair or replace Company-provided lighting that fails during normal use.
Maintenance may not cover problems resulting from:
- Customer modifications
- Damage caused by animals
- Landscaping work
- Construction
- Severe weather
- Vandalism
- Vehicles
- Falling branches
- Power problems
- Damage caused by third parties
- Unapproved movement or alteration of equipment
Additional charges may apply for service caused by circumstances outside our control.
Bulb and Color Matching
Replacement bulbs and lighting products may vary slightly in brightness, color temperature, appearance, or design due to manufacturer changes or product availability.
We will make reasonable efforts to maintain a consistent appearance.
Property Damage
Our crews use professional installation methods intended to minimize damage.
However, the customer acknowledges that holiday lighting installation may require temporary attachment to roofing, gutters, fascia, siding, landscaping, trees, railings, or other property features.
We are not responsible for pre-existing damage, deterioration, loose materials, hidden defects, or damage caused by conditions that were not reasonably visible before work began.
Any claim for property damage allegedly caused by our work must be reported promptly after discovery.
Landscaping
Lights or decorations installed in trees, shrubs, flower beds, lawns, or landscaped areas may require stakes, clips, cords, or other temporary installation methods.
We are not responsible for ordinary cosmetic disturbance associated with installation or removal.
Customers must disclose sensitive landscaping or areas that should not be accessed.
Takedown
Seasonal lighting will be removed according to our scheduled takedown period.
Customers understand that removal may not occur immediately after a holiday or on a specific date unless separately agreed in writing.
Weather and safety conditions may delay removal.
Customers should not remove Company-owned lighting themselves unless authorized.
Storage
When storage is included, Company-owned lighting and related materials may be stored by Santa’s Superior Lights between seasons.
Storage does not guarantee that every component will be reused the following year. Damaged, worn, obsolete, or discontinued products may be repaired or replaced as necessary.
Renewal for Future Seasons
Service does not automatically guarantee the same pricing, installation date, design, or product availability for future years unless expressly agreed in writing.
Returning customers may be offered renewal opportunities before installation schedules are opened to new customers.
Cancellation
Deposits and cancellation charges may apply once materials have been ordered, customized, prepared, reserved, or installation time has been scheduled.
Because holiday lighting is highly seasonal and installation capacity is limited, deposits may become non-refundable once preparation or scheduling has begun.
Any specific cancellation terms shown on the customer’s estimate or agreement will control if they differ from this section.
Customer-Supplied Products
If we agree to install customer-owned lights or decorations, we are not responsible for defects, failures, incompatibility, missing parts, weather resistance, or product quality.
Additional labor may be charged for troubleshooting or replacing customer-supplied products.
Photos and Marketing
Unless the customer requests otherwise in writing, we may photograph completed exterior lighting installations and use those photographs for portfolio, advertising, website, social media, and promotional purposes.
We will not intentionally publish private personal information with those photographs.
Limitation of Liability
To the fullest extent permitted by law, Santa’s Superior Lights will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the services.
Our total liability relating to a particular service will not exceed the amount paid by the customer for that service, except where prohibited by law.
Force Majeure
We are not responsible for delays or failure to perform caused by events outside our reasonable control, including severe weather, storms, natural disasters, utility failures, labor shortages, supply shortages, government actions, transportation disruptions, or similar events.
Website Use
Content on SuperiorChristmas.com is provided for general informational purposes.
Website photographs, examples, pricing references, promotions, and descriptions do not constitute a binding offer unless included in an approved estimate or agreement.
Unauthorized copying, reproduction, or commercial use of website content, photographs, designs, logos, or branding is prohibited.
Privacy
Information submitted through SuperiorChristmas.com is handled according to our Privacy Policy.
If customers opt in to receive text messages, message frequency may vary. Message and data rates may apply. Customers may reply STOP to unsubscribe from text messages and HELP for assistance.
Consent to receive marketing text messages is not required as a condition of purchasing services.
Changes to These Terms
We may update these Terms & Conditions from time to time.
The version in effect when a customer approves an estimate or schedules service will generally govern that service unless otherwise agreed in writing.
Governing Law
These Terms & Conditions are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.
